Text 2 Win Sweepstakes (the "Sweepstakes")
OFFICIAL RULES
NO PURCHASE REQUIRED TO ENTER OR WIN. SWEEPSTAKES VOID WHERE PROHIBITED. The details of the prizes and how to enter the Sweepstakes are contained in these Official Rules.
ELIGIBILITY. The Sweepstakes is open to residents of the United States and the District of Columbia (excluding New York, Florida, Rhode Island, Puerto Rico, Guam, U.S. Virgin Islands, and all other U.S. and foreign territories and possessions, and excluding where otherwise prohibited by law, rule or regulation) who are 18 years of age or older at time of entry. Void where prohibited by law. Employees of AEG Cycling, LLC (“Sponsor”), Anschutz Entertainment Group, Inc., and Amgen, Inc. and their respective affiliates, subsidiaries, advertising or promotion agencies are not eligible, nor are members of these employees' families (defined as parents, children, siblings, spouse, and life partners).
TIMING. The Sweepstakes begins at 8:00 am Pacific Time (PT) on January 14, 2008 and ends at 5:00 pm PT on February 24, 2008 (the "Promotion Period"). SMS Text Message entries received prior to or after the Promotion Period are disqualified. Mail-in entries must be postmarked by February 24, 2008 and received by February 28, 2008.
TO ENTER. There are two (2) ways to enter the Amgen Tour of California/Breakaway from Cancer Text 2 Win Sweepstakes. You may enter as many times as you like.
1. SMS Text Messaging: You may enter the Sweepstakes by sending a SMS Text Message anytime during the Promotion Period. The user will require a mobile phone with text messaging features. A $2.00 special text messaging fee will apply when the user registers to participate in the Sweepstakes. Check your carrier plan for your standard text messaging rates. To register and enter the Sweepstakes, text “DONATE” to 222377. Once the registration has been received and verified, the user will then receive a message confirming their entry into the Sweepstakes.
2. Mail-in Method: If you do not wish to enter by sending a SMS Text Message, you may enter the Sweepstakes by printing your name, address, city, state and zip code, day & evening telephone number and e-mail address (optional) on a standard size postcard and mail to: AEG Cycling, LLC, 1100 South Flower Street, Suite 3200, Los Angeles, CA 90015, Attn: Marketing Coordinator. Sponsor will only use e-mail addresses provided via the Mail-in entry method for prize notification purposes only; however, eligibility to participate in the Sweepstakes is not dependent upon entrant’s provision of this information. Mail-in entries must be postmarked by February 24, 2008 and received by Sponsor no later than February 28, 2008.
All entries become the property of the Sponsor and will not be returned. Sponsor, Anschutz Entertainment Group, Inc., and Amgen, Inc. and their respective affiliates, subsidiaries, advertising or promotion agencies are not responsible for lost, late, incomplete, garbled, illegible, or misdirected Sweepstakes entries, or for any error, human, technical or otherwise, which may occur in the processing of Sweepstakes entries. Proof of sending will not be deemed to be proof of receipt. All entries become the exclusive property of Sponsor and will not be acknowledged or returned. Any use of robotic, automatic, programmed or similar entry methods will void all such entries by such methods.
USE OF DATA. Sponsor will be collecting personal data about participants (including, without limitation, name, phone number, mailing address, gender, age e-mail addresses) when they enter the Sweepstakes. Sponsor is entitled to use personal data contained in all entry forms, whether by SMS text message or otherwise, in accordance with the Sponsor’s privacy policy. By participating in the Sweepstakes, entrants hereby agree to all personal information uses and disclaimers as explained in Sponsor's Privacy Policy at www.amgentourofcalifornia.com.
AGREEMENT TO OFFICIAL RULES. Participation in the Sweepstakes constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules and Sponsor's Privacy Policy at www.amgentourofcalifornia.com and to be contacted by telephone and/or email.
SELECTION OF POTENTIAL WINNER. Sponsor will choose nine (9) Daily Winners who will be selected at random from all of the eligible entries received. In addition, sponsor will choose one (1) Grand Prize winner who will be selected at random from all of the eligible entries received. Winners will be notified via telephone or email on or about February 28, 2008. Sponsor's decisions as to all matters related to administration of the Sweepstakes and selection of winner is final. Potential winners must comply with all terms and conditions set forth in these Official Rules, and winning and award of Prize is contingent upon fulfilling all requirements. If a potential winner cannot be contacted within SEVENTY-TWO (72) hours after the first attempt to contact such potential winner, then an alternate winner will be selected at random.
Winners must comply with all terms and conditions set forth in these Official Rules, and winning and award of prizes is contingent upon fulfilling all requirements. The decisions of Sponsor, including the selection of Winner and Finalists is final and binding on all matters relating to this Sweepstakes.
PRIZES.
Nine (9) Daily Prize Winners will each receive one (1) 2008 Amgen Tour of California prize package. Daily Winner Prize Package includes:
- One (1) official Amgen Tour of California overall race leader jersey and
- One (1) official Amgen Tour of California hat
One (1) Grand Prize Winner will receive one (1) 2009 Amgen Tour of California VIP Experience Package. Grand Prize Winner 2009 Amgen Tour of California VIP Experience Package includes:
- Roundtrip airfare for winner and one (1) guest from place the major airport closest to Grand Prize Winner’s residence (provided such residence is in the United States and the District of Columbia but excluding New York, Florida, Rhode Island, Puerto Rico, Guam, U.S. Virgin Islands, and all other U.S. and foreign territories and possessions) to one (1) stage (the “Stage”) of the 2009 Amgen Tour of California (Stage date and location to be mutually agreed upon between Sponsor and the Grand Prize Winner). Grand Prize Winner and guest must travel on the same itinerary. Roundtrip airfare for winner and one (1) guest from place the major airport closest to Grand Prize Winner’s residence (provided such residence is in the United States and the District of Columbia but excluding New York, Florida, Rhode Island, Puerto Rico, Guam, U.S. Virgin Islands, and all other U.S. and foreign territories and possessions) to one (1) stage (the “Stage”) of the 2009 Amgen Tour of California (Stage date and location to be mutually agreed upon between Sponsor and the Grand Prize Winner). Grand Prize Winner and guest must travel on the same itinerary.
- Hotel accommodations for Grand Prize Winner and guest at a 2009 Amgen Tour of California headquarter hotel which shall include one (1) room (standard rate/double occupancy apply) for two (2) nights stay. Hotel to be determined by Sponsor and based upon location of Stage.
- One (1) Caravan ride for winner and a guest in an official ATOC vehicle during Stage of the 2009 Amgen Tour of California.
- One (1) 2009 Amgen Tour of California merchandise pack autographed by one or more participating riders as determined by Sponsor and based on availability.
- Two (2) hospitality passes for Grand Prize Winner and guest to the selected Stage of the 2009 Amgen Tour of California.
Prizes are subject to the following material conditions and restrictions: Winners are responsible for any and all shipping and handling costs related to any Prize. Prizes do not include any ground transportation, meals or accommodations aside from aforementioned Prize assets. Any other expenses including, without limitation, taxes, gratuities, parking, ground transportation, meals, beverages and or expenses of a personal nature are the responsibility of Winner.
Except where otherwise expressly noted in these Official Rules, the selection of all vendors, prizes, products and services is subject to the Sponsors' sole and absolute discretion. Prize (and/or any portion thereof) is nontransferable and non-exchangeable. No substitutions or cash redemption of Prize is permitted except that Sponsor retains the right to substitute a prize of equal or greater retail value (or at Sponsor's election, the cash value of the applicable prize). Additional restrictions may apply.
All federal, state and local taxes related to the Prizes are the sole responsibility of Winners. All other expenses and costs, not expressly listed above, including but not limited to taxes, and any other expense or cost, not expressly included above, are the Winner's sole responsibility. No refunds or credit for changes are allowed. No transfer of any prize is permitted. Potential winner (and if applicable, winner’s guest who must be 18 years of age or older as of February 24, 2008 to be eligible) must execute and return an Affidavit of Eligibility/Release of Liability, Publicity and W9 within FIVE (5) days of notification. Noncompliance within this time period may result in disqualification, and an alternate winner may be selected. Return of any prize notification as undeliverable may result in disqualification and selection of an alternate winner.
Sponsor shall have discretion in designating the stages of the 2009 Amgen Tour of California at which certain prizes will be offered. All federal, state and local taxes related to the Prize is the sole responsibility of Winner. All other expenses and costs, not expressly listed above are the Winner's sole responsibility. No refunds or credit for changes are allowed
CONDITIONS, DISCLAIMERS AND LICENSE. The Sweepstakes is governed by the laws of the United States and the State of California, excluding conflicts of laws principles. All federal, state and local laws and regulations apply. Sweepstakes void where prohibited. Sweepstakes may only be entered in or from California and entries originating from any other jurisdiction are not eligible for entry.
Except where prohibited by law, Winners and guest grant to Sponsor and its advertising agencies the right to use and publish their photo, proper name, likeness, voice, opinions, biographical information and state in any media to promote Sponsor and the Sweepstakes without additional compensation.
By entering, participants release, indemnify and hold harmless Sponsor, Anschutz Entertainment Group, Inc., and Amgen, Inc. and their respective affiliates, subsidiaries, advertising or promotion agencies from any and all liability for any injuries, loss or damage of any kind, including death, arising from or in connection with the Sweepstakes or receipt or use and/or misuse of any prize.
Sponsor reserves the right to cancel or modify the Sweepstakes if fraud or any other factor impairs the integrity of the Sweepstakes as determined by Sponsor in its sole discretion.
SMS Text Message entries are deemed made by the authorized account holder of mobile phone number submitted at the time of entry. The "authorized account holder" is deemed the natural person who is assigned to a mobile phone account by a service provider, wireless provider, telecommunications carrier or other organization that is responsible for assigning mobile phone numbers for the submitted mobile number. A potential winner may be requested to provide Sponsor with proof that the potential winner is the authorized account holder associated with the winning entry and is a resident of the United States and the District of Columbia (but excluding New York, Florida, Rhode Island, Puerto Rico, Guam, U.S. Virgin Islands, and all other U.S. and foreign territories and possessions). Prizes will only be awarded to the authorized account holder
If, in the Sponsor's opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Sweepstakes, or if technical difficulties compromise the integrity of the Sweepstakes, the Sponsor reserves the right in its sole discretion to void any entries at issue (including disqualifying any individual who tampers or otherwise interferes with the entry process), and to cancel, terminate, modify or suspend the Sweepstakes, in whole or in part, at any time without notice. In the event of such cancellation, Sponsor reserves the right to award prizes in a random drawing from all eligible entries received before the time of cancellation.
Amgen Tour of California and Sponsor in no way promote illegal acts, and any and all entries which include or promote illegal acts will be disqualified.
Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction of unauthorized access to, or alternation of, entries. Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines or providers, failure of any entry received by Sponsor on account of technical problems or otherwise, including any injury or damage to entrant's or any other person's mobile telephone related to or resulting from participation in the sweepstakes.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
Participants in the Sweepstakes hereby consent to the exclusive jurisdiction and venue of California courts (state and federal) in Los Angeles County for any causes or controversies arising out of the sweepstakes. Each participant and any guest of winner waive any and all objectives to jurisdiction and venue in these courts.

Results will be available after March 5, 2008. Requests for results must be received by April 5, 2008
